If an officer refuses to identify themselves, it's not a lawful arrest, it's a kidnapping. I argued at the time that someone would be entirely within their rights to defend themselves in this circumstance. No doubt the DA would press charges but do you really think a jury would convict?
- notch898a 4y agoThe people doing that were CBP deployed in Portland under statutory authorization passed in the wake of 9/11. CBP are a federal police force who aren't required to follow the constitution within 100 miles of the border (so no need to follow constitution in portland) and any case would go to federal courts where 99% of cases end up in plea deal.
- giantg2 4y ago"but do you really think a jury would convict?" I have no doubt they would (assuming survival).
- vkou 4y ago> but do you really think a jury would convict? Would you bet your life on it? Or on the officers in question not gunning you down for your troubles?
- wing-_-nuts 4y agoBear in mind the alternative here are letting a group of unidentified randos throw you into an unmarked van. You're already betting your life on it.
- vkou 4y agoGetting kidnapped by US police is one of the few kidnapping situations where you are vastly better off not trying to fight. They have no problem with turning you into a corpse on the street, but, unlike your run-of-the-mill serial killer are probably not kidnapping you so they can turn you into one in their murder basement.

- notch898a 4y agoYou have to know who is kidnapping you first though. I don't think most people would be able to figure it out in time when a bunch of camouflaged federal police jump out of an unmarked van. You've got maybe a second at best to make the decision, and if you've done nothing wrong the idea some unmarked federal police force you've never seen before is going to snatch you up is probably not even in the realm of your imagination, thus it must be criminal kidnappers.
- soco 4y agoOnce again for clarity: you just don't know they are police.
