Why should not be AI tools open source? In what way are they different from any other tool or software? How do you want to forbid open sourcing the code which implements some math? Will you also forbid publishing of AI related research? Ok OpenAI will stop publishing their research now ... What good is in it? AI researchers will be loosing well deserved recognition. Right?
