This is my experience as well. The higher-ups slap "privileged" on nearly all emails, even when they have nothing to do with soliciting legal advice (e.g. a company-wide email about internal policy changes). I wish I'd hear stories about a company being sued, and during discovery opposing counsel finds the erroneous "privileged" markings, then the judge drops a hammer or something. I cannot imagine that happening. The most I can see is the judge appointing a special master to review everything marked privileged, but even that seems unlikely.
