There's nothing that says you won't also need a phone app just that you can't mandate payment through the phone app. It just says that there's no membership requirement and downloading an app is not a membership. BTW, Tesla has already created the technology they'll use for charging. It's called "Magic Dock" which is believed to a system where through the phone app you either unlock a connector that has CCS on the end of it, or you unlock the inner Tesla connector. By default it's the Tesla connector and you use the Tesla app to tell it that a non-Tesla car has arrived.
