I interpreted the article as stressing how difficult, yet important, it is to establish what works aren't in copyright so that content creators are able to freely use them with confidence. I'm not sure how you read it is as the opposite?

      Short quips on HN are usually relevant beyond the headline of the article. I assumed they were responding to some point the article was trying to make and went looking for it.
