The app in question is BSD 3-clause... the EULA can be removed by a forker, and perhaps it will be.

  I don't think it's as cut-and-dry as you're making it sound. This question seems like something you need an actual lawyer for.

    How is it not as cut-and-dry as it sounds? There is nothing in the source license which requires the developer to include the EULA in other works.
