Nah, AirPods can’t be forcibly activation locked. So, yes, they can be taken and used by someone else. (But they’re a low cost item.)
Anyway, Apple has decided there are only two ways to determine the owner:
1. Find My Activation Lock
2. Original Proof of Purchase
