The only possibly interesting part of this case to me is whether the development of paid products based on free open source models could be treated as some sort legal violation (it is definitely arguable that there is an ethical one). The actual data collection and training of the models themselves, I think, is fair use (?) since they are not sold directly and people are free to use them without buying an associated product/app.
Btw, for anyone curious on the pro-lawsuit takes, as I was, I found this tweet + replies to show a good representation of the artists on the other side of this, many of whom feel their work has been unfairly ripped off:
