"In a proposed class action filed on Wednesday, Christopher Lazazzaro said he would not have bought or would have paid less for Hershey's Special Dark Mildly Sweet Chocolate, Lily's Extra Dark Chocolate 70% Cocoa and Lily's Extreme Dark Chocolate 85% Cocoa had Hershey disclosed their metals content."
I'm curious how much less he would have paid if they had disclosed the lead poisoning. A Hershey bar is like 3 bucks. Maybe the lead version is worth a buck fifty, at most?
- aesh2Xa1 4y agoThe objective is for the plaintiff to demonstrate that he has standing. His standing is the loss of real money he paid for a product, and he can easily demonstrate how much he paid. If he decided to base his standing on something like "I might one day develop a health problem" then it would be far more complicated for him to prove. I doubt that Lazazzaro has much of an academic economic focus on the figure he would pay. It's just that he would have paid less than he did.
