Have you read the first amendment? It starts with Congress shall not make a law... FBI is not Congress.

  “FBI acted illegally (outside of Congress authorization)” works for me too

  Maybe, but the generally excepted judicial standard is "the government can't impugn freedom of speech, outside of a compelling interest." That includes the Executive.

  The FBI was created by an act of congress...thus it cannot infringe on first amendment protected activies.
