Tesla's claims are close to Theranos claims to have tech that it did not have. Why isn't Tesla guilty of fraud? Do they have a clause in their contract that saves them?

That wouldn't matter, in a comparable case the fraud victims are Tesla investors who lose out when the faked tech is revealed as such.

Tesla has delivered actual value to people in the form of a vehicle at least. Theranos provided zero value. Not a great comparison.

  Speaking to Autopilot specifically, in many people's eyes they have not delivered for a paid product.

    Isn't Tesla's autopilot "free", included in the price of the vehicle? AFAIK, you only need to pay for FSD or enhanced autopilot.
