I totally agree with you, but I put part of the blame on the journalists here. They've made it sound as if the problem is merely whether the building is being used as intended, rather than whether the building is being used as agreed - and they've failed to point out that zoning (and, I guess, taxation) would potentially be completely undermined if the regulators allowed companies to break agreements on how buildings are used.
