IANAL, but if incriminating shit has already been said, what's keeping law enforcement agencies and district attorney's from taking it up?
The more they wait around twiddling thumbs, even if the strategy is to build a robust case by using his public statements, the more public discourse starts steering to enforcement not being able to touch supposed elites.

DA's can't charge someone until a grand jury hands down an indictment and the results are sealed until the prosecutor file the charges. I think that ship has sailed.

I speculate that his arrest is coming shortly if they can get her cooperation as a witness and evidence.
