Same-Sex Marriage Bill Passes Senate After Bipartisan Breakthrough
- jfengel 4y agoI had wondered what kind of law you could actually write. Does it follow the pattern of Constitutional amendments, or what? Here's the text (of the House version): https://www.congress.gov/bill/117th-congress/house-bill/8404/text https://www.congress.gov/bill/117th-congress/house-bill/8404... Key bits: No person acting under color of State law may deny— “(1) full faith and credit to any public act, record, or judicial proceeding of any other State pertaining to a marriage between 2 individuals, on the basis of the sex, race, ethnicity, or national origin of those individuals; or “(2) a right or claim arising from such a marriage on the basis that such marriage would not be recognized under the law of that State on the basis of the sex, race, ethnicity, or national origin of those individuals. If I'm reading this correctly, it doesn't actually require states to allow marriages in that state. But it has to recognize marriages performed in other states, and it can't pass "marriage is one man and woman" laws. The Supreme Court decision requires them to accept marriage license applications from same-sex couples. That much could be overturned later. Since they still have to accept that there will be same-sex married people in the state it would just be carping, but I suspect it will happen anyway. Assuming that the Supreme Court doesn't overturn this law as well. Which I suspect it could.
