Suing Your Employer for Laying You Off Is Probably a Bad Move
- jleyank 4y agoSuing in cases where state or federal law has been broken is reasonable I would think, or participating in prosecution in such cases - worker support and all that. Suing when nothing has been done illegally is a different case. In my layoff experience, the 60-day notice of WARN was handled by "get out of here, you're on staff but offsite for 60 days. When that completes, your severance is processed based on what you signed and how you behaved.". The 60-days was considered normal employment. Vacation accrued, heath insurance, etc. was paid. HR stressed if we left employment during that period there was no severance because I quit - had to wait the full time to trigger it along with the paperwork. This was a technical solution to WARN and a reflection of the at-will nature of employment. I assume similar calendar games are being played in the tech field right now.
