There is some confusion about the definition of "affirmative action". The original definition from Kennedy's Executive Order 10925 requires that government contractors "take affirmative action to ensure that applicants are employed, and employees are treated during employment, without regard to their race, creed, color, or national origin". What the supreme court is poised to do would in a sense reaffirm the original principle of affirmative action.
