Treason refers to the betrayal of one’s own country by attempting to overthrow the government through waging war against the state or materially aiding its enemies.
According to the United States Constitution, Article III, Section 3, “Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.”
Furthermore, 18 U.S.C § 2381, states that a person guilty of treason against the United States “shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.”

Three key elements are necessary for an offense to constitute treason: an obligation of allegiance to the legal order, and intent and action to violate that obligation. Treason is a breach of allegiance and of the faithful support a citizen owes to the sovereignty within which he lives.
- legitster 4y agoAgain, I don't think Russia is technically an "enemy" of the US right now. Elon is also certainly not levying war against the US. And if simply talking to a foreign power and then advocating peace constituted treason, we would have had to execute a huge number of journalists during the Cold War or the War on Terror. And for the record, Treason laws have not been enforced in the US since WWII (and even then just barely). Elon may certainly be guilty of something, but I don't think treason specifically.
