I don't really see how this is any worse than the current "do whatever you want regardless of what everyone else is attempting" that manufacturers currently go

I don't really see how this is any worse than the current "do whatever you want regardless of what everyone else is attempting" that manufacturers currently go by. But as other commenters point out, provisions exist to assist with this.
