The class action lawsuit revolves around a "violation of privacy".
I don't think that's the correct attack on Meta, as harm is hard to
demonstrate and privacy is hard to define.
What is really happening is much more dangerous. People are being
discouraged from seeking medical help because they fear that proper
confidentiality is not assured.
If a single person fears using an online health service because of
these big data corporations, and they fail to get a timely medical
diagnosis, then said companies harmed that person.
That's a real and tangible harm, and what's ultimately going to
happen here. The lawyers should change tack. Don't look for victims
who claim they "didn't know" Meta was tracking them. Find victims who
demonstrably did know, and acted in a negative way. Seek to find
evidence that the reasonable expectation of privacy being violated
caused someone to be denied healthcare access.
Targeted advertising based on grubbing around in people's personal data
is disgusting, and Meta and Google are likewise disgusting companies
that should not exist in a civilised society.
