Ask HN: GitHub + OpenAI + Open Source Software
Clearly a trend of Open Source Software projects leaving GitHub as a result of the GitHub/Microsoft partnership with OpenAI and OpenAI ingestion of the code without regard to the licenses, in part because GitHub’s terms of service enables it.
What I don’t understand though is how switch platforms stops someone cloning the code from another platform and reposting it to their repository on GitHub.
Am I missing something, and if not, is there a solution to preventing this?
- verdverm 4y agoWhat data is there that shows "clearly" a trend has formed?
- akagusu 4y agoGithub uses its terms of service to circumvent licenses and avoid potential legal consequences. But if they clone repositories outside their services, they can't use its ToS to shield itself since the only thing applying here is the license.
- O__________O 4y agoDid you read the post? Key phrase is — “...and reposting it to their repository on GitHub” — which is my point, all it takes to undo a project leaving GitHub is for someone to clone the project back to GitHub. Also mentioned GitHub’s terms of service as the legal out for GitHub’s actions in my original post.
- akagusu 4y agoAgain, it's the license.
- O__________O 4y agoExplicitly stated the assumption was that the project left GitHub - but a third-party downloads it then reposts it to GitHub. What license would forbid this in a way that’s enforceable prior to it being ingested for GitHub’s use per their terms of service?
