This makes some good points not everyone realizes but I'll add some caveats: This is way more relevant in common law countries (US and UK) since in other countries judicial decisions are a lot less important. Also, it's probably a little litigation focused. For transactions lawyers, for example, their value is in negotiating a better deal.
