From the article, emphasis mine:
> “I’m working hard with my team to have something that is common sense, something that is legally sustainable because of course there’s challenges when we get sued every day of the week,” Hochul said. “But I want to make sure that we’ve done everything we can to protect the citizens of this state.”
> She added: “I will go right up to the line, I will not cross the line, but I know that we can do whatever we can to protect New Yorkers.”
> Lawmakers, however, didn’t see the specific language of the bill when they arrived in Albany, and they were expected to work through the night to pass the bill when it lands on their desks.
It takes multiple years for a court challenge to make its way to the SCOTUS but they can't even spend a day debating the merits of whatever changes to gun laws they want to impose, let alone debating whether it will be thrown out for again violating the Constitution.
I really think it's an intentional strategy. They know the laws they are proposing or passing are not constitutional, but they simply don't care because the entire time that it has to work it's way through the courts to challenge these laws is considered a "win". Like the law from less than a month ago that raised the age to purchase a semi-automatic rifle in NY to 21: https://www.nbcnewyork.com/news/local/hochul-set-to-sign-ny-gun-control-bills-in-wake-of-buffalo-mass-shooting/3721598/ https://www.nbcnewyork.com/news/local/hochul-set-to-sign-ny-...
That's clearly in violation of the Constitution and a similar law in CA was recently (two months ago) throw out by the relatively liberal 9th circuit: https://www.npr.org/2022/05/11/1098432386/california-21-gun-sales-ban-unconstitutional-court-says https://www.npr.org/2022/05/11/1098432386/california-21-gun-...
But again, they don't care. To quote the governor of neighboring NJ, Phil Murphy, (talking about COVID lockdowns but the logic remains the same): "I Wasn’t Thinking of the Bill of Rights When We Did This".
