I don't think this lends credence to the claims he was murdered at all — As the article states: the body hasn't been released because of the ongoing / unresolved legal case.
Because of this, releasing the body — so it can be buried or cremated — would be tantamount to destroying evidence.
So what choice do the Spanish authorities have given such a situation? The ball seems firmly in the court of McAfee's widow's legal team, AFAICT.

They have obviously conducted a thorough autopsy and collected samples etc, so this argumenent that by having a legal dispute you cannot have a funeral seems odd to me, a layperson. Many many people have disputed a cause of death in Spain without a body being held this long. But I'll hold off on anything specific since I haven't followed the case closely, I just have a gut feeling he'd be more likely to make some kind of zip gun or shiv and end up dead during a prison escape than simply kill himself. (I also doubt he'd hang himself, since unlike hanging in the 1800s in America, where you drop from height, "hanging" in a jail is a slow painful death, and I don't think based on what I've read that is how John would have wanted to end his life even if he did decide to commit suicide)
