I'm rather surprised you would identify an obscure visa regulation as "the" reason, and not say anything with available venture capital, tax and employment regulations, and the risk taking culture. In practice it's not really a problem. The labour market test has been relaxed since of couple of years and should not pose a barrier to granting a visa.
