This doesn't even seem like it'll accomplish what's intended. The goal is to hold the company accountable, but it sounds like they just created legalized paid-fall guys. If the government wants to pierce the limited liability veil, they should either go after the persons in the company either directly or ultimately responsible (eg the direct manager, or the C-suite). Letting the company decide who takes the fall just means they're going to foist it on some uniformed schmuck. You get paid more for being on-call - now wait until you see the legaly-liable-for-the-entire-company bonus!
