A state by state push would be one way to make this happen, but given that online companies and their users are often in different states, this does seem like the kind of interstate commerce that could be addressed federally. I'm not hugely optimistic about this. It's possible that the pushback against tech will enable something like this to get passed, but I'm pretty sure that pushback is for purely for political points and not being done with any intent to actually change much.
