Have you done any arbitrations with employee cases? Mandatory arbitration in low wage employment was the hot topic a few years ago.
- thathndude 4y agoNever got into the employment context. But wage and hour cases (FLSA) have made many a rich lawyer. I will say, while I am generally not anti-arbitration, I do think it has its limits, and when it is used as a tool to suppress information that should be out in the public, I am completely opposed to it. The Example I often use are cases where an individual is suffering severe sexual-harassment. If that person is forced into arbitration, unable to share their story (confidentiality required), and hamstrung in prosecuting their claims by the arbitration process, that’s a losing situation for the entirety of society.
