I don't understand how Disney's position hasn't simply been laughed out of court. Aren't they effectively arguing for ending the ability of corporations to form contracts? If contractual obligations can be discarded simply through M&A, how can any contract be enforced?

Unless I misread the article they didn't get sued so far, just publicly shamed (on twitter presumably). Suing costs a lot of money.
