It all seems kind of obvious and dull.
Of course he's broken that part of the agreement. Do you think people are seriously denying it or excusing it? Is the sky going to fall on him because someone noticed?
I'd rather read what Matt Levine wrote about it today, although that's also pretty obvious:
"Usually the way it works is that if the buyer wants to issue an inflammatory press release, it goes to the seller for permission, and the seller says “what, no,” and the buyer realizes that it didn’t actually want to issue an inflammatory press release, and, you know, that’s why they have this section.
But here they also have Elon Musk, and when he wants to Tweet he Tweets. Of course he spent last night tweeting disparaging things about Twitter and its employees. What are they gonna do, sue?"
"...there is no similar provision allowing Twitter to tweet freely about the deal; I suppose that was considered unnecessary because no one on Twitter’s board or executive team uses the product. Except founder and board member Jack Dorsey, who has tweeted some nice things about Musk and the deal."
