If you made that land I would agree with you, but you didn't so I can't. Imagine if somebody purchased half of the existing radio spectrum and then decided to just leave it unused for decades. We wouldn't allow it. Perhaps if they compensated society by paying a tax for the exclusive use (or non-use) of it then we could justify it.
