I'm of the opinion that as long as a company has policies to never restore legitimately deleted data from backups, then backups of deleted data simply shouldn't count. Everything else is just too ugly to implement. Though I get the impression that regulators are not happy with this opinion, and what that data to be physically deleted within some timeline.
