> Exclusive marketing agreements are still allowed, but the FCC is requiring broadband providers to disclose those agreements to tenants
- jka 5y agoBasically an exclusive agreement like that would (I think) mean that for a rental agency R, and cable companies A and B, the rental agency could agree that only either A or B would be able to provide marketing materials (for example, pamphlets, e-mail mailing list offers, coupons or deals) to tenants of R properties. The competitor would not be allowed -- according to the deal terms -- to provide those to the same tenants. Those kind of agreements are, in some ways, only slightly less pernicious than the exclusive revenue-sharing agreements mentioned in the article that the vote does intend to ban (where R could receive a cut of the ongoing customer payments from the cable company that they enter a deal with). And because it's 2022, almost all of the communications provided by the cable companies in either of the revenue/marketing situations above would be carefully crafted so as to (try to) avoid arousing the suspicions of consumers that they've been entered in a non-competitive environment to begin with.
