California sues Tesla, saying it permitted racial discrimination at its factory
- outsrcthrway 5y agoHow much do such lawsuits raise the cost of hiring USA employees, versus the savings of just sending their jobs to China and Mexico?
- muzika 5y agoInteresting question. It’s getting insane lately how many loops employers now have to jump through in order to avoid lawsuits.
- swivelmaster 5y agoYou created this account… just to post this comment? Okay, sure, the lawsuits are the real problem, not the discrimination, of course.
- MisterSandman 5y agoYour point being? Peoplr should stay quiet because God forbid the cost of hiring employees for one of the most profitable companies in the world goes up?
- ldiracdelta 5y agoIt's a huge problem for the USA. We have more lawyers than any other country on a per capita basis and we don't have "loser pays". To begin to estimate the cost premium that it puts on companies in the USA you look at how big the legal industry is in America and then you have to add "the chilling effect" that the probability of unjust "justice" is exacted on corporations with misaligned incentives for lottery-level payouts ( resolved with loser pays)
- ALittleLight 5y agoIf I recall correctly from looking over the previous lawsuit most, or all, of the people who used these racial slurs were themselves racial minorities. Just my intuition, but I'd guess that these racial slurs are more common among particular demographics. If that's true, and you can be harshly penalized for permitting the use of racial slurs, then it seems like the state would be creating a perverse incentive not to hire specific demographics out of fear those demographics would use language that would get the company sued. "After receiving hundreds of complaints from workers, D.F.E.H. found evidence that Tesla’s Fremont factory is a racially segregated workplace where Black workers are subjected to racial slurs and discriminated against in job assignments, discipline, pay and promotion creating a hostile work environment,” Kevin Kish, the department’s director, said in a statement. “The facts of this case speak for themselves." So, one black employee sues Tesla because coworkers use racial slurs against him. He wins 137 million dollars in the lawsuit. Then many other employees accuse the company of using racial slurs. Hmmm, why, Tesla must indeed be overrun with racists then.

- Wiseacre 5y ago> discriminated against in job assignments, discipline, pay and promotion How are the black employees responsible for that?
- ALittleLight 5y agoPerhaps that's happening, and it would be bad if it were, but there's also a massive incentive for employees to claim it's happening whether or not it is.
- BoiledCabbage 5y ago> Tesla segregated Black workers into separate areas that its employees referred to as “porch monkey stations,” “the dark side,” “the slave ship” and “the plantation,” the lawsuit alleges. ... > Graffiti — including “KKK,” “Go back to Africa,” the hangman’s noose, the Confederate Flag and “F-- [N-word]” — were carved into restroom walls, workplace benches and lunch tables and were slow to be erased, the lawsuit says. It's incredible to me that on a story with quotes as absurd as the above, that the two main comments here are painting Tesla as the victim for one. And the incredible "solution" of, "hmm maybe companies next could stop hiring black people as opposed to actually stopping an incredibly racist environment." https://www.latimes.com/business/story/2022-02-11/la-fi-tesla-race-discrimination-lawsuit https://www.latimes.com/business/story/2022-02-11/la-fi-tesl... The refrain is often "I'm tired of hearing about racism". And you don't think people are even more tired of being the recipients of racism?
