India proposes 30% tax on crypto and NFTs income
- bryanrasmussen 5y agodoesn't it become income when you actually turn it into normal currency? Or would you be forced by this law to convert some of your holdings to pay the tax? Can you pay the tax in crypto? Since it says "India’s central bank will also introduce a digital currency in the next financial year, she said. The nation’s central bank has been testing its CBDC in different trials for several months in the country and examining its impact on the banking and monetary systems." it implies to me you would be able to convert to CBDC and pay in that? Anyway a 30% tax isn't really a lot, although don't know what the tax rate is in India, I pay basically 50% of my income in tax.
- Anunayj 5y agoEven though there isn't really any law clearly regarding cryptocurrencies (think of this like a legal grey area), if you consider cryptocurrencies as assets Right now, short term capital gains (Holding < 36 months or maybe 24 months) were taxed at 15% flat on selling (when you realize it's value), while Long term capital gains is taxed at a base 20%* * The actual percentage is based on inflation index, reimbursing losses to inflation, this practically ends up around 12.5% + other surcharges for a 2 year period. So 30% would effectively doubles the amount of tax to be paid. Refer to https://www.incometaxindia.gov.in/tutorials/15-%20ltcg.pdf https://www.incometaxindia.gov.in/tutorials/15-%20ltcg.pdf for more information. Now Things get REALLLY murky when you get into staking/mining/receiving crypto in exchange for goods and services, for that it's easier to report it as "Income from other sources", which is taxed according to tax slabs based on your full income (5/20/30%) (for 2022). Now Ideally, these (as they are a income) should be paid at the end of the financial year (before March 31st with the rest of your income tax) in INR (at the exchange rate on the day you received/generated the asset, you can take care of any capital gain/losses later), but well that can be sometimes impractical, and you might have to sell some of the assets to actually pay the tax, if this is your only source of income. Ofc it's probably a better idea to get hold of a professional to do this for you, and this by any means is not tax advice. I do not have any idea about the CBDC.

- rep_movsd 5y agoThis is much better news than the idea that they would completely ban all official crypto/fiat conversions through exchanges.
