Meta Sues for Data Scraping; Claim: Banned Users Creating New Accounts = Hacking
- zinekeller 5y agoI'll (reluctantly) give this to Meta, since that what Meta actually accuses is unauthorized access, not necessarily "hacking" in popular parlance, and it seems that then-Facebook has formally sent letters to the company that they're disallowing any authenticated access to Facebook. The Google case relies on unauthenticated access only, and while the LinkedIn case is still in court and although the circuit's decision is that hiQ can access the data, the case is now in the supreme court in wake of van Buren. Also I bet that they included c(1)(A) (the fraud part) just because they can, it's really about the c(1)(B) (unauthorized use of data) part that has a better standing. Also the title is a disservice, it compresses the nuance of the court case into a clickbaity headline.
