This article sure does cherry-pick a misleading image for the Prada. Here's another view: http://dailymobile.se/wp-content/uploads/2008/11/lg-prada2-04.jpg http://dailymobile.se/wp-content/uploads/2008/11/lg-prada2-0...

And if Apple had written a similar piece, it would have manipulated the image to be the exact same width as the phone it's comparing it to. And the article uses a press image of the Prada from LG by the way, while your link leads to a horrible, grainy image of a Prada II.

Exactly - the standard is if the registered art resembles past art in the eyes of a discerning citizen (normal, non-technical person) and of course that's up for interpretation. Apple will have to fight this region-by-region and they wont win in all markets, because the standards are fairly open to subjective interpretation of what "similar" means to the average person.

The KE850 original Prada (not the KF900 in your image) has long been compared with the iPhone. http://translate.google.com/translate?sl=sv&tl=en&u=http%3A%2F%2Fmacworld.idg.se%2F2.1038%2F1.92144 http://translate.google.com/translate?sl=sv&tl=en&u=... http://www.roughlydrafted.com/RD/RDM.Tech.Q1.07/72B08E9A-D467-45EA-B214-28D3A340C3E5.html http://www.roughlydrafted.com/RD/RDM.Tech.Q1.07/72B08E9A-D46... http://www.mobilemag.com/2007/01/18/lg-ke850-touchscreen-phone-separated-at-birth-from-iphone/ http://www.mobilemag.com/2007/01/18/lg-ke850-touchscreen-pho... http://en.wikipedia.org/wiki/LG_Prada_(KE850)#iPhone_controversy http://en.wikipedia.org/wiki/LG_Prada_(KE850)#iPhone_controv...

LG didn’t sue and they are also not selling the phone anymore. It’s irrelevant. I’m disgusted by what Apple is doing but this is not an argument.

The KE850? Interesting. Take a look at it in action. Notice the on-screen keyboard one needs for entering text. http://reviews.cnet.com/cell-phones/lg-ke850-prada-unlocked/4505-6454_7-32316442.html http://reviews.cnet.com/cell-phones/lg-ke850-prada-unlocked/...
