Novak Djokovic: Is his saga an unforced error for Australia?

- ggm 5y agoYes. Putting to one side I think he's a bit of a nong, this is a classic stuff up of delegated authority to approve visa, the actual authority to approve a visa, the contextual authority to deny a visa after its issued, the role of airlines, state vs federal politics and delegated authority, and a government with an election inside six months looking for a distraction from their other unforced errors in covid management. Morrison is a populist. He knows this plays well. Well.. he thought he knew. The playbook here is a phrase "we will decide who comes to Australia and the manner in which they come" from a torrid, evil refugee problem. They ran through the numbers, saw this as a popular decision against a very public antivaxxer and went there. The extent to which it has blown up is still being debated: in marginal seats at risk to more right wing minor parties this play may have done its job. What the courts think about it, as procedural fairness or equity or in law is another matter. And since the state hosting the tennis is Victoria and is Labor held, it's a double win for Morrison if he can make them look stupid (it's on the cards, the advice tennis Australia under the Victorian government's rules handed out looks suspiciously like they got it wrong) Djokovic may have a few unforced errors of his own. When he was infected, what proofs and how he's behaved during his infectious period are not working in his favour. Every step of the way somebody could have said "wait.." (I'm an Australian, and a "Roger or Rafa" man myself, never liked Novak but that's not the point here)
- version_five 5y agoWhen I saw the story the other day, I had thought it was good that he wasn't above the rules (whatever you think of the rules). I realized reading this there is a lot more to it than that - like you say, it feels like it was calculated to provoke the reaction it provoked in me, but ended up jerking Djokovic around in an unnecessary way (and it mentions there was another woman coming to play who was also deported). I am definitely against any kind of special rules for certain people, but this seems to be something different and completely political.
- ggm 5y agoA reddit discussion (a bit scurrilous) Legal merit of Novak's appeal https://www.reddit.com/r/auslaw/comments/ryur1j/legal_merit_of_novaks_appeal/ https://www.reddit.com/r/auslaw/comments/ryur1j/legal_merit_... Has the court filings: https://www.fcfcoa.gov.au/migration-law/online-file/djokovic https://www.fcfcoa.gov.au/migration-law/online-file/djokovic Another one: Court documents are up for Novak Djokovic v Minister for Home Affairs https://www.reddit.com/r/auslaw/comments/ryv369/court_documents_are_up_for_novak_djokovic_v/ https://www.reddit.com/r/auslaw/comments/ryv369/court_docume... The federal government asked for a 2 day delay to the hearing. The judge denied it.
