Isn't this clear destruction of evidence? I believe, at least in some jurisdictions, if it can be proven there is destruction of evidence there are additional charges and the opposite side's claims about the evidence are assumed to be true. I have no idea if this is the case in federal criminal courts, but I'd love to hear from someone who knows.
