There never was a varna system. You are just repeating Arya Samajist fantasies that anachronistically project modern ideas back. For instance those same grhyasutras that mention not marrying sagotra also mention the rathakara as an example of a jati that does not belong to a varna. I think a lot of the criticism of caste is based on silly assumptions but it will not help to defend if we make our own silly assumptions.
