Scraping public data doesn't result in compelling another person to work under a false premise. Sure, you could argue that scraping introduces load that may draw an operator's attention... but the comparison is a pretty big stretch. How these things pass board review I don't know... it seems pretty obvious to me that creating work for somebody who didn't volunteer to it is, at best, antisocial behavior.
