Hershey Goes on a Threat Blitz Against a Bunch of Independent Breweries
- ArtWomb 5y ago>>> Yuengling "Hershey's Chocolate Porter" interesting...
- twoodfin 5y agoI suppose you can think trademarks shouldn’t exist or should be dramatically more limited in enforcement, but common sense suggests that if you’re calling your pastry stout “Almond Joy”, Hershey will have a good case for infringement.
- CogitoCogito 5y agoThis isn’t remotely comparable. Whatchamacallit is generic and these are separate market categories.
- twoodfin 5y agoSure, but I’m suspicious when it’s the only one cited out of a “bunch” by a clearly hostile Tech Dirt. Some quick searches on Untappd suggest there are a number of breweries using Hershey trademarks unambiguously to imply their beer has one set of flavors or another. That’s likely infringement whether Hershey makes beer or not.

I don’t really see much sense in such an argument so feel free to clarify your point if I’m not understanding you correctly.
- alasdair_ 5y agoI’m from the UK and Hershey’s has always tasted like vomit to me. (I mean this completely literally.) I just learned why from the tech dirt comments - apparently (and unlike European chocolate) Hershey’s contains butyric acid, the same acid found in vomit.
