As an engineer, I wouldn't dare leave this behind. If some copyright lawyer finds out, might he sue? Even if meritless, the company would not like the legal hot water. And recalling the silicon is expensive, compared with a software patch. Not saying that's what happens, just that I would not want to personally shoulder the risk.
