It's funny because I was discussing this just the other day wishing there was a better way to address that fact pattern--a history of biased decisions--without dragging irrelevant and inflammatory stuff into the mix. Sadly, nobody in that discussion could quite find a good way to reference it without the inflammatory bits at the time.
