That was my thought as well, over here, if a car rear-ends you, both conductors stop, call their respective insurance companies, wait until a representative arrives and let them deal with the consequences. As an individual we don´t have bargaining power vs stupid automotive choices. But insurance companies have in their best interests to make sure somebody else will pay.
