Sue a billion dollar company? I'm not sure that's a solution for the vast majority of people. Fighting discovery is generally step one in the process of dealing with this sort of lawsuit. Something like this could/will take years, and hundreds of thousands of dollars to deal with. It would be likely cheaper to buy a whole new car every year for five years than to take Tesla to court.
