What is the specific point the Poles are in conflict with the EU? Marriage = 1 man and 1 woman? Only Polish people can make pierogi? The article wasn’t clear.

- dagw 5y agoFrom the article Poland: "judges in Poland's highest court last week ruled that the national constitution had primacy over EU law." EU: "If we don't uphold the principle in the EU that equal rules are respected the same everywhere in Europe, the whole Europe will start collapsing. That is why we will have to react to this new chapter which the Polish constitutional court started to draw."
- jmpman 5y agoRight, but what specific rules are in conflict between the Polish constitution and the EU law? Religion, equality, immigration, abortion, taxes, property ownership, ingredients in beer?
- detaro 5y agoThe main point of contention is independence of the justice system. EU says Polish law gives the government too much power over justices and that this violates EU treaties about the EU justice system, which require an independent judiciary. Poland says that its constitution doesn't allow the EU to have that power over Poland. (specifically the trigger is some some new-ish committee that is allowed to remove justices from office etc.)
- Arnt 5y agoAdding to that — if Poland accepts European law and courts today, then tomorrow it has to accept a European law it didn't write about corruption, or a ruling by European judges who weren't appointed by the accused ministers.
