Poor Pappa's gets to defeat diversity, but I don't think that even the 5th circuit saves Tesla on this one. If plaintiffs want a jury trial, they're going to get a jury trial. No doubt they can come up with experts to opine that Autopilot's design is defective and unreasonably dangerous, and that Tesla failed to exercise reasonable care in the design / marketing / whatever of Autopilot. And, I'm sure the shareholder derivative lawsuit attorneys are excited at the near certainty that the Tesla board won't do their fiduciary duty wrt to CEO's chosen legal strategy.
