Trade secrecy might be the only way to protect it = good and bad. If someone else creates it you have no protection because you have no patent. If they steal the trade secret you have some protection - ephemeral. This will lead to enslaved AIs, with the slave master claiming the patent - ultimately this form of slavery will be outlawed and an AI will be able to be a free entity.
