Pornhub Is Facing Legal Action from the Louvre over Classical Content
- mimixco 5y agoI don't think it'll work. Museums like to claim copyright over works which A) were created before copyright existed and B) would have had their copyrights expired long ago anyway. It's mostly a scare tactic. Big publishers will comply when they print books with images of famous paintings, but I can't think of a successful museum lawsuit against anyone for using famous art in a product. Can anyone else? One thing often misunderstood about copyright by both creators and consumers is that it's automatic, it's owned by the creator, it doesn't transfer with the product, it doesn't transfer at all except through explicit written agreements, and it eventually expires. This means that all paintings are copyright by the painter and, since the Louvre cuts off at 1900, everything is expired and public domain. So fire up those digital printers and make your own Mona Lisa or a remix!

- antiterra 5y agoFor Italy, in particular, we’re not talking about US or treaty copyright law. Their claim is based on their cultural heritage code.
- mimixco 5y agoI read that in the article. Does Italy have any legal jurisdiction over PornHub? They're probably a Cayman company or something like that, right? I suppose the content could be blocked in Italy but that's about it.
- cinntaile 5y agoThe parent company is MindGeek and it's based in Luxemburg according to Wikipedia.
- antiterra 5y agoThe jurisdiction doesn’t extend past their borders, but the cultural heritage law is not satisfied by a geographical block on the content. Italy has recently empowered a regulator to block sites domestically for IP violations. Additionally, Italy could make things difficult for any executive that visits the country and restrict any transactions with Italian advertisers.
- mimixco 5y agoI don't think PornHub will care. The idea of Italy restricting porn ads in their country to certain companies is quite hilarious. The government says you can advertise this porn, but not this porn. Super!

- musicale 5y agoPresumably part of Caravaggio's madness was due to toxic pigments (and he may have died from lead poisoning) but he is a fascinating character and an astonishing (and occasionally terrifying) artist!
