Biden Executive Order Calls for Ban on Noncompete Agreements
- AnimalMuppet 5y agoYeah, I'm going to go out on a limb and guess that he doesn't have the power to do this. You're going to need a court decision to ban them. Presidents do not get to re-write contract law by executive order. Note well: IANAL.
- jfengel 5y ago"Limit" seems more likely than "ban". There are legitimate use cases for noncompetes. But the argument is that they're being used in a lot of cases where there's no legitimate need, but solely to tie the workers down. That may lead to a ban on certain types of noncompetes. The FTC has a fair bit of leeway from Congress to regulate anti-competitive behavior. Companies may well decide to force a judge to rule on the limits of FTC's power, but it's not something the President is doing just by waving a magic wand.
- samstave 5y agoCool. May we please add term/age limitis for people in congress/supreme court... Oh and lets ban insider trading protections for those in congress? Good Idea. Maybe we should be much more transparent with wealth growth in congress and the government at large, especially when it comes to light that the guy who was supposed to achieve peace in the middle east and his wife made $650 million whilst serving in whatever capacity that was - and the fact that another offspring was allegedly paid $00 million from the chinese, or some $80 million from the russians, depending on who one would like to believe... So lets take some steps at the top level. e.g. J. Kerry "flew to russia today for a short visit to discuss climate change" On a private jet, with an entourage, and likely security... This motherfucker ever hear of a zoom meeting? Surely, he would have preferred all kids to zoom to school with masks on whilst talking to a webcam... so why did he have to "fly to russia to discuss climate change"?
